1. General Provisions
  1. This Public Offer Agreement (hereinafter – the “Agreement”) defines the terms and conditions under which the Complex provides temporary accommodation and additional services to the Guest.
  2. The Agreement is a public offer in accordance with the Civil Code of Ukraine and is valid from the moment of its publication on the Complex’s website and/or other information platforms.
  3. By making a Booking and/or paying for Services, the Guest fully accepts this Agreement and agrees to comply with its terms without exception.
2. Definitions
  1. “Complex” means the entities providing the services, namely: Equi Lis, Khytir Falchi, Dacha Koncha Zaspa.
  2. “Guest” means any person who has made a Booking and/or is using Services at the Complex.
  3. “Services” means temporary accommodation, additional services, and any other services provided by the Complex under this Agreement.
  4. “Booking” means a request or confirmation for temporary accommodation in the Complex.
3. Booking Procedure
  1. The Guest makes a Booking by completing the online form or contacting the Complex’s administration. The Booking becomes effective upon confirmation by the Complex and/or payment of Services.
  2. Payment for Services confirms the acceptance of this Agreement and guarantees the Guest’s right to temporary accommodation in the selected cottage for the agreed period.
  3. The Complex reserves the right to refuse Booking in cases provided by this Agreement, the rules of the Complex, or applicable law.
4. Refunds
  1. The Guest has the right to refuse the Services and request a refund in cases defined by this Agreement.
  2. To submit a refund request, the Guest must provide the Complex with the following information and documents:

    • Full name;
    • Taxpayer Identification Number (TIN);
    • Registration address;
    • Bank account number in IBAN format and the bank card number used for payment;
    • Scan of the payment receipt from the Payment System confirming payment for the Services.
  3. Upon receiving a refund request within the period specified by this Agreement and after receiving the required information and documents, the Complex shall refund the money to the Guest within 5 (five) calendar days from the date of receipt of such request.
  4. Failure of the Guest to comply with the deadline specified in this Agreement and/or failure to fulfill any of the conditions of this Agreement constitutes grounds for refusal to refund the money.
5. Rights and Obligations of Guests in the Equi Lis, Khytir Falchi, Dacha Koncha Zaspa Complex
  1. The Guest has the right to:

    • use temporary accommodation and additional services in the order specified in this Agreement and other documents and rules of the Complex;
    • receive complete and accurate information about access hours to the Complex, the cost of Services provided at the Complex;
    • contact the Complex staff regarding Service quality, leave complaints, reviews, and suggestions on the website and/or social media pages of the Complex, as well as other resources.
  2. The Guest undertakes to:

    • comply with the provisions and conditions of this Agreement;
    • respect the rights of other Guests of the Complex;
    • observe moral and ethical norms, refrain from using obscene language in public areas of the Complex;
    • comply with the rules of residence in the Complex, general rules for using equipment and infrastructure facilities of the Complex;
    • protect the property of the Complex — the Guest is responsible for the risk of destruction and/or damage to the Complex’s property within the value of such property or within the cost of restorative repair. Payment for restorative repair or destroyed property caused by the Guest must be made by the Guest before departure or within 1 (one) banking day from receipt of the relevant claim from the Administration;
    • comply with fire safety rules and rational (economic) use of electrical appliances and equipment of the Complex, including:

      • it is prohibited to use faulty outlets and electrical appliances; in case of discovering damage, the Administration must be notified immediately;
      • it is prohibited to store explosive and environmentally harmful substances;
      • it is prohibited to use candles, sparklers, or personal cooking equipment (burners, etc.);
      • fire may be used only in specially designated areas. The Guest bears full responsibility for leaving fire unattended.
    • In case of a dangerous situation, immediately notify the Administration and follow the main requirements of general fire safety rules.
    • During the operation of fireplaces/hearths, it is prohibited to:

      • leave them unattended;
      • use them if defects or damage are found; use fuel briquettes;
      • place flammable substances and materials directly in front of the hearth opening;
      • store cigarette butts and ashes in metal containers installed on a wooden floor or flammable base;
      • dry (place, hang) shoes and clothing, firewood, or other flammable items and materials on the hearth;
      • use flammable liquids for kindling stoves;
      • use firewood longer than the size of the firebox.
    • The Guest is solely responsible for his/her own safety, life, and health, as well as the safety of minors staying with him/her;
    • The Guest confirms that his/her health condition allows staying in the area and using the provided services, including the bath services.
6. Rights and Obligations of the Complex
  1. The Complex is obliged to:

    • provide paid Services to the Guest in a timely, high-quality, and complete manner;
    • inform the Guest about Services provided on the territory of the Complex and the form and procedure of payment;
    • promptly respond to the Guest’s requests regarding temporary accommodation, taking measures to eliminate malfunctions and accidents in the cottages in the shortest possible time;
    • be responsible for the completeness and serviceability of equipment in cottages, as well as for the quality of preparation of the cottage for settlement.
  2. The Complex has the right to:

    • enter the cottage for cleaning, linen change, checking water supply, heating, air conditioning systems, or eliminating deficiencies by agreement with the Guest, as well as in case of violation by the Guest/user of the provisions of this Public Offer;
    • after 100% of the paid accommodation period ends and/or if the Guest is absent for more than 2 hours without payment, independently vacate the cottage of the Guest’s personal belongings, making an inventory of property left by the Guest;
    • in case of more than two violations by the Guest of generally accepted norms of behavior, invite law enforcement officers to clarify circumstances and establish facts of such violations;
    • terminate the Agreement for temporary accommodation early, without refund of paid funds, with simultaneous forced eviction from the Complex in case of:

      • being in a state of severe alcohol and/or drug and/or toxic intoxication or under psychotropic substances;
      • smoking in cottages or on the Complex territory, except in designated areas;
      • storing or using weapons, explosives, flammable, caustic, poisonous, narcotic substances, and other dangerous items without the Complex’s approval and necessary permits;
      • violation of public order;
      • violation of residence rules;
      • violation of this Public Offer;
      • systematic complaints from other Guests regarding violation of their rights and freedoms.
  3. The Complex is not responsible for:

    • money, belongings, or any other material values left in the cottage, lost on the Complex territory, or missing for any reason;
    • the impossibility of providing Services for reasons beyond the Complex’s control;
    • actions of any third parties;
    • possibility or impossibility of payment by bank card via the Payment System, its operational reliability, and the security of information provided by the Guest to the Payment System;
    • any material or moral damage, any direct or indirect losses caused to the Guest not due to the Complex or as a result of force majeure;
    • injuries caused by negligence while on the territory (falls, injuries on stairs, nature, etc.).
  4. Notwithstanding any provisions of this Agreement, the Complex declares, and the Guest accepts and agrees that any material liability of the Complex is limited to the cost of Services paid by the Guest.
7. Additional Services of the Complex
  1. For Guests who have booked a cottage and paid for Services, the Complex provides the following services free of charge:

    • use of parking on the territory of the Complex;
    • wireless Internet access;
    • baggage storage;
    • use of barbecue equipment and/or fire pit area near the cottage;
  2. Other additional services are provided at prices indicated in the informational documentation of the Complex and/or on the website/social media pages.
8. Special Conditions
  1. On the territory of the Complex it is prohibited to:

    • invite and bring third parties onto the territory of the Complex and into cottages without the consent of the Administration;
    • transfer the key to the cottage to third parties;
    • move furniture and rearrange interior items in the cottage;
    • take any furniture or equipment out of the cottage;
    • smoke in cottages and in other areas not designated for smoking;
    • disturb the peace of other Guests of the Complex by creating noise or commotion;
    • store or bring weapons, explosives and flammable, caustic, poisonous, narcotic substances, fireworks, salutes, and other dangerous items. Guests who have the right to carry and store weapons are obliged to notify the Administration on the day of arrival, presenting the corresponding permits;
    • knowingly pollute the territory of the Complex with cigarette butts, trash, etc.;
    • throw any objects or items from terraces or windows;
    • show aggression or actions that threaten the safety, health, or property of other persons;
    • use personal irons, kettles, immersion heaters, or other heating appliances not included in the cottage equipment.
  2. In case of violation by the Guest of the rules of conduct and/or duties, the Administration has the right to refuse the Guest further provision of Services, and accordingly, his stay on the territory of the Complex, with mandatory compilation of the relevant act and, if necessary, involving law enforcement officers.
  3. The Complex has the right not to provide Services to persons who:

    • provided false information during Booking;
    • are in a state of severe alcohol and/or drug and/or toxic intoxication or under the influence of psychotropic substances;
    • violate the conditions of clause 8 of this Agreement;
    • intend to settle in the cottage with a greater number of persons than provided by the corresponding category of the cottage;
    • violate the rules of the Complex (Simple Rules of Recreation in the Complex), or the rights of third parties, or the current legislation of Ukraine.
9. Procedure for Staying with Pets
  1. Staying with pets in the Complex is allowed with prior agreement with the Administration and additional payment. At the same time, the Complex reserves the right to prohibit staying with pets in certain cottages.
  2. Pets are allowed to be on the entire territory of the Complex on a leash.
  3. The Complex has the right to request a veterinary certificate of all animal vaccinations and other documents required by law at any time.
  4. After walking the pet, the Guest must collect the excrement in a special bag and dispose of it in a trash bin.
  5. Feeding pets is allowed only from special dishes provided to the Guest after a booking request, or from dishes brought by the Guest for the animal.
  6. It is prohibited to comb pets in the cottage or on the territory of the Complex.
  7. It is prohibited to use towels, sheets, and other bedding of the Complex after washing the animal, except for those specifically intended for animals.
  8. The Guest bears full responsibility for any damage caused by the animal. In case of serious damage, the Guest undertakes to reimburse all expenses associated with the consequences of the damage.
  9. The Complex reserves the right to refuse to provide services to Guests staying with a pet in case of violation of the residence rules or aggressive, inadequate, or noisy behavior of the animal.
  10. The Guest undertakes to prevent pets from exhibiting dangerous actions towards people, other animals, and property.
  11. The Guest undertakes to maintain silence on the territory of the Complex and not violate public order.
  12. The Guest bears full responsibility for the life, health, and safety of his/her pet(s) during the stay in the Complex.
10. AS IS
  1. Services are provided by the Complex on an “as is” principle. This means that the Complex provides Services, and the Guest receives the Services in the form in which they can be provided at the current time, in accordance with the technical, operational, and other capabilities of the Complex. The Guest accepts the Services in advance with all defects that have appeared immediately or may appear later.
  2. The Guest has no right to make any claims or demands against the Complex due to the fact that the Services do not meet any expectations or provisions not indicated in this Agreement.
11. Amendments to this Agreement
  1. The Complex has the right unilaterally to make changes or additions to this Agreement with or without notifying the Guest, and the Guest gives his consent to such changes.
  2. If the Guest continues to use the Services of the Complex, it means that he unconditionally accepts the changes made.
  3. If the Guest does not accept the changes, he must notify the Complex in writing. In this case, the Guest does not receive Services and has the right to a refund according to the terms of this Agreement.
12. Collection and Accounting of Personal Data
  1. All aspects directly or indirectly related to the processing and protection of the Guest’s personal data are determined by the Privacy Policy, which is posted on the Complex’s website.
  2. By making a Booking, the Guest confirms that he is familiar with and fully agrees with the Privacy Policy.
13. Force Majeure
  1. In the event of force majeure circumstances (floods, earthquakes, fires, strikes, emergency power outages, changes in legislation, etc.), the Parties are partially or fully released from performing obligations.
  2. The Guest accepts the terms of this Agreement during the martial law; therefore, circumstances such as war or military actions, as a general rule, are not considered force majeure unless they directly prevent the fulfillment of a specific obligation.
  3. The Party for which the performance of obligations has become impossible must notify the other Party in writing no later than 3 (three) calendar days from the moment of their occurrence.
  4. The occurrence of force majeure circumstances must be confirmed in the manner prescribed by law.
  5. The Parties understand and agree that this Agreement is concluded during martial law. The Parties may refer to such circumstances as force majeure only if they are actually present and have a proven impact on the fulfillment of obligations.
